handed this duck a slice of bread and the i would have swore the duck said thanks fat head and then flew away.did this duck actually say this or am i losing my grip on realty

It was a wereduck!!!! LOL, JK.

My cat says "Hello" And "Mom" and "Wow"
My dad’s dog says "I luv you!!!"
So a duck could inturns say "Thanks Fat Head." and not know that he said that. I can easily picture it, "Quaakss, Quack, Quaack". Seriously, It is entirly possibly.

Now if you start hearing voices telling you to kill someone then you need to go see a shrink. Outside of that, you seem to be fine.

short sale or give back to bank

this is an extension of my last question. my best friend is about to loose her home to a foreclosre but she has it in realty. she told me today that the bank (small town – everyone knows everyone) said they would take back the house without any forclosure on her record, her and her husband will just leave the house (i guess) and the bank will sell it on their own. but her real estate agent is pushing for a short sale and im sure they are doing that to still get some kind of commission. which way would be better – give the home back to the bank with no forclosure or have a short sale?

She does have some equity in the home, but with the market now, no-one is buying, at her asking price now she will only come out with 25,000.00 after realestate fees and payoff. she would like to use this money to get started somewhere else with less of a monthly payment. if she short sales or gives back to the bank she will have no money to get started somehwere else and with bad credit on top of that… what to do?

That would depend on how much equity they have in their home. If there home is appraised at a lot more than the loan balance, try to sell it. That way, your friend might at least make a profit from it. They did pay money into it. It’s only fair that they get something out of it. If however they lost value on it since purchasing, they might want to go with the bank’s idea. But, whatever you do with the bank, get it in writing. Just because it doesn’t show up as a foreclosure doesn’t mean it can’t show up as a deficient account and turn into a collection account.

Can my landlord enter my apartment without contacting me beforehand?

A couple of weeks ago, I signed a form stating that I would not be re-leasing my apartment (I live near a university so they try to get an early start on showing apartments for the upcoming school year). Since then, the realtors that I rent from have been entering my apartment on an almost daily basis to show it to prospective renters. I know this only because they have been calling my PARENTS (I gave them my parents’ number as an "emergency contact"). They have my number but they still give me NO notice.

On Wednesday I was walking up to my apartment and saw my dog sitting on the stairs – he had been let out by the realtors, and this p*ssed me off, so I went into the realty office and asked them to PLEASE, PLEASE start calling me first. He told me that during showing time, they could enter at any reasonable time of day without having confirmed it was okay with me. So I showed him in the lease where it said I needed to be notified *24* hours in advance. He said, "oh, well that doesn’t apply right now." That was yesterday. Today they called my parents while they were at work about 30 minutes before they planned to show my apartment and I found out just now that they showed it THREE times today while I was not there.

Who is in the right here? I don’t know what else to do – I’ve told the realtors they were violating the terms of the lease and they said they weren’t. I’ve given them my number over and over. I just don’t know what else to do and feel their actions are bordering on harassment. Thanks in advance

Your in the right. The lease says it very clearly. The lease is still in effect.

1) Talk to someone in the realitors office who’s hire up the chain of command. Their argument that the lease doesn’t count is just silly.

2) File a law suite in small claims court, or renters court. The idea here is that a law suite will get their attention.

3) File a restraining order. A simple restraining order that they can’t go into your apartment.

4) Stop by the realtor and tell them you set a trap (don’t really set a trap).

5) Put something in the apartment that will scare them. Like hang a dead rat from the ceiling. Oh, I like this one. But I’m a passive aggressive jerk, so you may not want to do this one. But…. Hang a dead rat from the ceiling, where everyone can see it. They’ll open the door to show a client, and then "surprise". When they get pissed off, you say "well, I’ll tell what. If you call before you come over, then I’ll remove the rat" Or leave dead animals, or dead bugs. Or, I guess it doesn’t have to be anything creepy. Just leave a big huge disgusting mess.

Addition. I just thought of this. Leave a mess in the kitchen, just a small mess. But make it look like you where eating something completely disgusting.

A Bachelor man, Nadeem is excited as today he would be meeting a girl called Nazia along with his parents and decide whether or not she would be his life partner or not. Nadeem and his parents meet the girl and his parents and they do not approve the girl, as she is dark in colour. That night when Nadeem goes to sleep, he sees a dream. In the dream he comes across a man called NAFS

NAFS: “ O my master, what can I do for you”?

Nadeem: “Well, can you get me a beautiful girl whom I can marry?”

NAFS: “ Yes Master! As you say”

Within a blink of the eye, the NAFS is present with a beautiful fair girl with lovely wide eyes who is dressed in a bridal outfit.

Nadeem: “ Wow! She is so beautiful.”

Nadeem asks the girl her name. The Girl identifies herself.

The girl: “ My name is Dream”

Nadeem: “ Where do you hail from?"

Dream: “ I live in your subconscious. I can visit you only when you are asleep”

Nadeem: “ You mean I can never get to marry you in reality?”

Dream: “ No.”

Nadeem: “ O NAFS why the hell have you brought this girl who does not exist in reality?”

NAFS: “ Because Master, she is the most beautiful girl according to you and as she said, she lives in your subconscious. Well you can enjoy being with her as long as you are asleep. The same with me, I shall vanish as soon as you wake up.”

Nadeem: “ Then how can I get nearer to her in reality?”

NAFS: “ Well, it is possible only in one situation, I can put her inside the body of Nazia whom you and your parents rejected this evening”

Nadeem: “ But Nazia is dark and Dream is exactly the opposite of her in appearance”

NAFS: “ But at least you alone would be knowing that inside Nazia exists your Dream.”

Nadeem: “ Well but Nazia is not the delight of my eyes and not only that, others will laugh at me for marrying Nazia”

NAFS: “ Well, then the world you live in is really ridiculous because they want to run away from realties. We here who live in your dreams know that Materialistic Perfection does not exist in the real world that you live in.”

At this point Nadeem wakes up from his sleep and just ponders over his dream. He takes a decision there and there that he would marry Nazia and he conveys this to his parents who somehow are convinced by Nadeem but they are as astonished as to what changed his decisions overnight.

Nadeem: “ Well Mom and Dad, there is nothing like perfect beauty. Contentment is what truly makes everything look beautiful”

Taking house off the market & changing realtors?

I’ve had my house on the market for about two weeks now and I’m very dissatisfied with the realty company selling it. And it’s not because of activity either. I understand the market/economy today. The reasons are too many to list, but the bottom line is this…the company seems to be ok with me taking my house off the market. However, I may be rethinking the situation and selling it myself or going with another realty company. One of the agents is coming to collect the lock box and For Sale sign in a few hours, and to provide me with a form to sign, permitting them to take my house off the internet mls listing. My question is this…is this a standard form used, and is there any time line or clause that generally says one cannot relist a property with someone else, or sell it themselves, within a certain amuont of time? Or is it just cut and dry and releasing me from their mandate? I’m very mistrusting of this form, and the company, and what it may, or may not, say in keeping me connected to them. BTW, the agent never left me a copy of the listing contract when I signed two weeks days ago. Just another reason of why I believe they are not doing things professionally. I live in NJ, if that helps. Thanks to all opinions and advice…

The forms used by the realty company must comply with state law. There might be a clause relating to relisting and if the property is eventually sold to someone they originally showed the house to they will be owed a commission. You need to read your listing agreements before signing them

When a house sign says "sold" does that mean it’s in escrow or escrow has been completed?

I’m interested in a home and it has a realtor sign out front. Recently a "sold" star was put on top of the sign. Does that mean the house is in escrow or does that mean the sale is complete and escrow has gone through? I can’t get a hold of the realty office today.
And when I look on the realty website it says "contingent". Does that mean I can still put in an offer and if escrow falls through my offer would be considered? Also, how often does escrow fall through?

Escrow has nothing to do with your question. Escrow is a holding place to keep monies needed in the future. "Sold" means it went to closing. You don’t see this often because most realtors take down their sign once it’s sold. If it says "contingent" then the sale will only go through IF something else happens – usually loan approval, inspection, title search, etc. Some states will allow a "contingent" offer, but if would only be considered if the contract fell through. Contracts falling through didn’t used to happen often, but now the banks are pickier and it’s happening a little more often, but still not to most contracts.

I’ve been looking for an apartment for a while. I found one in July but because of bedbugs I was able to get out of my lease right away. The realty place that I found that apartment through checked my credit and gave me the credit report. The place I called today is a direct affiliated with the first place so I just wanted to know if they would have to run my credit again. This woman was immediately upset by this asking me "How did you get your report?" I told her I didn’t understand the question since I had already stated they gave it to me because I paid for it. I didn’t see what the problem was since they only gave me a copy. It’s my report. She repeats her question slowly this time with more attitude "I said HOW…DID…YOU…GET…YOUR…REPORT? They were not supposed to give it to you. They can send it to people. I’ve done this for 30 years never had a problem. If a store checks your credit they won’t give you your report" So I usually have an issue with people walking all over me since I look and sound young but I decided to assert myself. After politely reminding her that you do not PAY for a credit check for an in store credit card I said "With all due respect, there really isn’t anything you can do about it now. I paid for it, it’s mine, they already gave it to me. I just wanted to know if you needed to check it again since one of your ‘partners’ checked it already. I’m sure you know every hard inquiry drops my score"

After this she was completely dismissive of me. She gave short uh-huh answers for everything else I asked which I found quite rude. I’m only 27 but I have looked extensively into the world of "credit". I know most of the rules and I do not see the problem with obtaining a copy of the credit report that I PAID FOR from a realty agency. I have to go there after work and normally I wouldn’t care but since she was dismissive of me I’m sure I will have to ask the same questions and that might jog her memory of me. Causing me some trouble. Do you think as a receptionist and probably the first person I have to see when I walk in she will cause me trouble? How do I avoid this lady?

I’m sure she has a boss, you might want to report her. If they weren’t supposed to give the report to you, then she should be addressing them instead of giving you grief about it. Especially since you paid for it.

okay so i like this guy….hes a junior and im a sophomore and his prom is coming up but he wont ask me. Every time i talk to my guy friends and i pass him he gets realty jealous and after school today i was talking to his brother he got so mad and also in the halls he gives me a flirty smile but we neverr talkkkk

does he like me?

You need to start talking to him. Unless he is really outgoing, he isn’t goin to approach you if he hardly knows you. Start making conversation with said individual and if all else fails, ask him yourself. It is possible he already has a date or just simply isn’t going as well.

Could I sue for Punative Damages?

Ok- in the March 2011 i gave a total of $2000 to a woman from a realty group to get a home for my husband (who at the time was in Basic Training with the Army) myself and two children. she said $200 of it was for a lawyers fee and she needed most of the money in cash. Its a long complicated situation but basically she knew i had to be out of my current house by June 1st due to forclosure. In may before i went to my husband BCT graduation, she showed me my new home . a 2bd 2bth house, very cute, and in a nice neighborhood. A week after i came back from his graduation and 5 days til June 1st, she told me that i dont have the house and that there was a termite problem. ( i already gave my husband the address and had letters going there) Alot of the confusion during this time was due to her saying i had a place and then renigging, giving me one excuse after another. When i asked for my money back, thats when she told me i had the 2bd house. Today is June 1st. I have no house and my children and i had to sleep in my car last night. ( I had no money for a hotel because i have been buying furniture for our "new home" because my husband and i are starting completely over fresh) Today they are at my aunts house and i will be going to put a deposit on a house that is very small and not in the best area. I feel as though i have to settle in order for my children and I to have a roof, which is fine – but all of this has made me very stressed out and depressed beacuse i feel as though i failed my kids and my husband for trusting this woman with our money. I had to put most of our things in storage and also lost some things that i could not get out of the "old house" in time. And I also DO NOT have my $2000 back yet. She has plenty of excuses as to why i wont get my money back for "a while"… what can i do?

Yeah, this whole situation screams of a scam. My husband and I also bought a house recently, so I can tell you from experience that the realtor is NOT supposed to accept money from you. They get paid AFTER selling you the home.
You should go to the "realtor’s" office and confront her in person. Unless she has a real, legitimate reason, supported by tangible evidence, why she cannot give you your money back, my advice is to call the police. They should investigate whether or not the realtor is legit. You’ll need to tell them exactly what laws you think she might be breaking and where to find her .
If all goes well – that’s is to say, they find out she’s a fraud – the police should tell you what your next steps should be. Like whether or not you’ll need to file a suit to get your money back.
If she IS a legitimate realtor and she took money from you like this (She’s not supposed to.) THEN you should contact the state’s Real Estate Commission and the Better Business Bureau and get her license taken.

The realty company I have rented from for four years is trying to get me to pay for professional carpet cleani?

Sorry this may be a little long, but I’m at my wit’s end at this point.
Four years ago I rented an old farmhouse through a realty company. The lease stated that I had to have the carpets cleaned when I moved. When I signed the original lease, the company gave us the keys a couple days early because I ASKED if we could get in early and clean the carpets. The house was old and needed cleaning badly, but I figured I could do it. They gave us permission and never said "don’t worry, they were just cleaned." So I cleaned them and the water from the carpeting was filthy and smelled like urine. Four years later, I am moving out. We’ve been going back and forth about this issue and today they called to tell me that I have to get them done AND that the carpeting was new when I moved in. That carpeting is 20 years old if it’s a day, and had stains.
The lease was also very ambiguous as to the notice I had to give. I gave 30 days as I read that I was supposed to, then they came back and told me that I had to give 60, and that if they didn’t rent it for June I would still have to pay June’s rent. However, they want the keys back May 31, the date I gave in the letter. They’re telling me I have to have a professional come in over Memorial Day weekend? So my second question is, if I’m on the hook for June’s rent, do I have to hand the keys over or can I just say I’m keeping possession until June 30 since I’m paying anyway? I’m really very tempted to NOT pay June’s rent and tell them to keep the security since it’s looking like they’re going to nickel and dime me to death on that.
What’s my best course of action?
Let me be clear; I have been in constant contact with them for the past month. The subject of the carpet was brought up two weeks ago; I told the agent that they had not been cleaned before I moved in and she kept putting me off saying she’d check with the other agent and get back to me. I got my final answer as to whether I had to do this this morning. That’s why I’m in a time pinch, because I moved last weekend and would have had time to get them done sometime this week if I’d known. They were NOT professionally shampooed before I moved in, and if they can show me an invoice that they were, then I’ll do the same.
I understand that a deposit is not rent, I do. But if I pay for this month when I don’t even have access to the house and then they piddle my security deposit away when I’ve done nothing but improve this property, that’s not fair and leaves me with the short end of the stick.

This is what it says, which obviously I didn’t understand correctly: "This lease will automatically renew for a term of two full calendar months at the ending date unless" etc. Any other lease I’ve had reverted to a month-to-month lease after the end of a year, and I didn’t think this was any different, since there was also a clause specifically mentioning month to month leases.
I suppose my biggest mistake was trusting that they’d be above-board, decent people, especially since I’ve been a model tenant, never called them for anything and only made the place nicer…new stove, new shower, stripped and sealed linoleum floors and landscaping. Go figure.

They cannot both charge you another month’s rent and keep the keys; it’s one or the other, not both.

What does your lease say about notice? If your lease does state that 60 days notice was required, then it doesn’t matter what you "read somewhere," you were obligated to give 60 days notice. If your lease states 30 days, however, then you did what you were supposed to and they cannot charge you an extra month of rent. As you already know, you can’t use the security deposit in lieu of rent.

It doesn’t matter if the carpets were shampooed before you moved in; you agreed to have them professionally cleaned in your lease. After 4 years, this is definitely to be expected. The condition of the carpet before you moved in is irrelevant, unless they are replacing it and attempting to charge you for the full cost.

You need to read your lease and see what notice was required. If 60 days notice was required, then simply pay the extra month of rent, and schedule a professional carpet cleaning for sometime that month. If only 30 days was required, then you do need to have someone come out this weekend, or ask the landlord if he is ok with you hiring a RugDoctor and doing it yourself. Sorry, but you should have had this done when you moved out last week. Your issue here is not the carpet cleaning, but the extra month of rent.
